Terms of Service

Please read these Terms of Services carefully (“Terms”) before using any service on News Coverage Platform. By accessing and using any part of or services on News Coverage Platform, you unconditionally agree and accept that you have read and been legally bound by these Terms, manual guidance, and other operating rules, policies that may be attached, supplemented, and amended, from time to time.

Article 1. Interpretation

In these Terms, unless otherwise provided hereinunder, capitalized glossaries shall be defined as follows: 

  • 1.1 Account: means account on News Coverage Platform that is or has been created by or for the User to use News Coverage Services.
  • 1.2 Community Standards: means any and rules, regulations governing the Users’ behaviours where User make any comments, posts, reactions, and otherwise expresses his/her opinions, viewpoints to any contents, features including bulletins, information, news sites, functions, service quality, product package, service fee, administrator and/or any part belonging to News Coverage Services on News Coverage Platform.
  • 1.3 Content: means information, data, text, artworks, photographs, videos, audio clips, music, written posts, articles, comments, reviews, logos, trademarks, software, scripts, graphics, designs, user interfaces, visual interfaces and interactive features generated, provided, or otherwise made accessible on News Coverage Platform or through the Services. Content also includes User Content and Linked Content. 
  • 1.4 Personal Data: all information relating to an identified or identifiable person; and any information that may be used to identify you and that is not otherwise publicly available. 
  • 1.5 Privacy Policy: means the policy explains how we collect, use, share and process personal information of User and/or other relevant individuals on News Coverage Platform. 
  • 1.6 Terms of Services: means a legal binding agreement between you/User who uses News Coverage Services (hereinafter referred to as “User”) and Endurra Technology Company Limited (hereinafter referred to as “Endurra Tech” or “we” or “us” or “our”), regulates terms, conditions, rights, and obligations of Parties during your use of supplied Services on News Coverage Platform. 
  • 1.7 User or You: means any individual who registers, opens an account and accept these Terms to use and/or engage under whatsoever manner with News Coverage Services on News Coverage Platform.
  • 1.8 News Coverage Services or Services: means any service, product to be supplied on News Coverage Platform to supply bulletins, information, newsletters and news in brief as recapitulated, extracted from online, electronic and/or digital news sites, newspapers, magazines, journals based on User’s selected, customized and lawful contents, topics including but not limited to functions of reading, filtration, summarization, sharing, commentation, tagging, reaction on such summarized bulletins and other functions that to be developed on News Coverage Platform and other value-added services to be supplied together and/or connected with News Coverage Platform, from time to time.
  • 1.9 News Coverage Platform: means any software and/or platform including newscvg.com, mobile applications, system software, servers, system hardware and other information technologies systems that Endurra Tech has used to supply Services from time to time. 

Article 2. Account Registration 

  • 2.1 In order to use Services, you must be, and represent and warrant that you are, of legal age, 15 years of age or older or otherwise of legal age in your jurisdiction, or if you have parental consent, 13 years of age. If you are in the U.S. and under 13, you may not use our Services under any circumstances or for any reason. Our Services are not targeted at anyone who is under 13 years of age. Before registration of an account on News Coverage Platform, you need to read, agree and accept all provisions in these Terms and/or other regulations, policies, and other relevant rules during your use of Services. Such regulations, policies and rules are integral parts of these Terms. 
  • 2.2 You have limited, revocable, non-exclusive, non-transferable right to use account on News Coverage Platform from time to time. You are entirely responsible to maintain your account on News Coverage Platform to link with only one email address or other third-party account (if applicable).
  • 2.3 You agree and promise that the information provided by you to us, including during the registration process, is complete and accurate to the best of your knowledge. You will promptly inform us of any changes to your information. You are entirely responsible for maintaining the confidentiality of the information you hold for your account, including your username, password, details of your payment method associated with your account and all other activities that occurs under your account. You are not allowed to share your login details or give your login details to anyone else. We may cancel or suspend your access to your account and the Services if you share your account login credentials to anyone. Your registration is for your single use only, and you are not allowed to let, lend or otherwise transfer your account to any third party. Endurra Tech is not responsible to any damages relating to your username, passcode to be illegally used by anyone.
  • 2.4  Any and all communications sent to or from e-mail address that you have provided/updated us or via notification within your account on News Coverage Platform shall be deemed to send to or from you. You undertake to maintain your e-mail address in good status to receive our communication and will promptly inform us of any changes to your e-mail address. We may assume that any communications we receive under your account have been made by you. You agree to exempt Endurra Tech from any liability if your registered e-mail address is unable to receive information from us due to whatsoever reason.
  • 2.5 You may choose to access News Coverage Platform through a third-party, and if you do this, you give us permission to access and use certain information from that third-party account. By using our Services, you are permitting us to collect, store, keep, and use any of the information you have permitted the third-party to provide to us. You can control the amount of information accessible to Endurra Tech by adjusting your privacy settings within your third-party account. We will use this data in accordance with our Privacy Policy. 

Article 3. Services & News Coverage Platform

  • 3.1 You agree that by registration, acceptance of these Terms, accessing, using of News Coverage Platform and/or downloading the Services, you acknowledge and agree to act and require Endurra Tech to supply Services through and via News Coverage Platform. 
  • 3.2 Every and/or communications/requirements that we receive under your account have been made by you, whether or not such communications, requirements have been actually made by you and you are fully responsible for all communications, requirements that occur under your account. 
  • 3.3 Upon particular demands, Endurra Tech may customize our Services on your permanent selection, decision, behaviour, interests in order to facilitate you to explore, discover and/or use Services at your demands, interests, hobbies and/or desires to enhance user experience on News Coverage Platform.
  • 3.4  Our Services is provided on personal use basis for the informational purpose only. Your registration is for your single use only. In all cases, you may not distribute, license, transfer, sell or otherwise commercialize, in whole or in part, any of the Services or any derivative works thereof. You further agree not to use, transfer, distribute, and/or dispose of the Services or Content in any manner that could compete with the business of Endurra Tech or any of its partners. 
  • 3.5 From time to time, we may change, suspend or discontinue any aspect of the Services at any time, including the adjustment, modifying, ceasing, discontinuing, or disabling availability of any Services features, database, Content, functions, part or whole Services. We may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability.
  • 3.6 You may download, copy, share the Content and other downloadable items displayed on the Services, News Coverage Platform for your personal use only, provided that you maintain all copyrights and other notices contained in the Content and other downloadable items. Copying or storing of any Content for other than personal use is expressly prohibited without prior written permission from us or eligible owner, or the copyright holder identified in the copyright notice contained in the Content. 
  • 3.7 You may download, copy, share the Content and other downloadable items displayed on the Services, News Coverage Platform for your personal use only, provided that you maintain all copyrights and other notices contained in the Content and other downloadable items. Copying or storing of any Content for other than personal use is expressly prohibited without prior written permission from us or eligible owner, or the copyright holder identified in the copyright notice contained in the Content. 

Article 4. Terms of Services 

  • 4.1 Where using Services, you agree to voluntarily agree, accept and comply with these Terms and/or other relevant rules, regulations, policies during your use of Services. Depending on how you use the Services, other terms might also apply to you if you use specific services. Additional terms may also apply for promotions, sweepstakes, contests, giveaways, or similar programs. If these Terms are inconsistent with any such policies or additional terms, the terms of the applicable policy or the additional terms shall apply. 
  • 4.2 From time to time, we may revise these Terms with or without giving prior notice. If we do make such revisions, we will post an updated version on on newscvg.com (and update the “Last updated on _____” reference). By continuing to use the Services after the updated version has been posted, you agree that you accept any changes to these Terms. If you do not accept these changes, please stop using the Services.
  • 4.3 You deem to receive notification, if notices:
    • 4.3.1  has been posted on newscvg.com, or 
    • 4.3.2  sent to your e-mail address that has been registered at your first registration of Services; or 
    • 4.3.3  sent, notified or updated via News Coverage Platform.
  • 4.4 Provisions herein also apply to changes of any other regulations, guidance, conditions, rules that are integrals parts of these Terms under Clause 2.1.

Article 5. Service Fees

  • 5.1 You agree to pay Endurra Tech any and all fees applicable to your subscription to any of the Services (“Fees”) and any other applicable fees charged by Endurra Tech from time to time in connection with the provision or use of the Services. Fees will be announced publicly from time to time upon Services’ particular package.
  • 5.2 We reserve the right at any time to charge fees for access to portions of the Services or the Services as a whole. In no event, however, will you be charged for access to the Services unless we obtain your prior agreement to pay such Fees. Thus, if at any time we require a fee for portions of the Services that are now free, we will give you advance notice of such Fees. You may cancel your account at any time. All new Fees, if any, will be posted prominently on the News Coverage Platform itself and in other appropriate locations on the Services. All Fees and charges shall be billed to and paid for by you. You shall pay all applicable taxes relating to use of the Services through your account.
  • 5.3 The Fees (including the fee for your subscription to the Services and any other fees) charged by Endurra Tech shall be payable in advance and are strictly non-refundable. To the extent as allowed by applicable law, the Fees may be automatically charged on subscription cycle basis under official payment means as provided on relevant app stores which depends on your downloaded version of News Coverage Platform (eg. iOS, Android or web-based Platform). If you wish to cancel your subscription, you must follow the app store’s relevant cancellation policies.

Article 6. Rights and Obligations of Users

  • 6.1 You can stop using Services within limited period at any time without notice to Endurra Tech unless otherwise provided in Clause 12.3 or termination of account.
  • 6.2 User’s obligations 
    • 6.2.1 To provide accurate and up-to-date information, strictly comply with registration process, Privacy Policy, Community Standards, other requirements and guidance from Endurra Tech during your use of News Coverage Platform.
    • 6.2.2  To use your account as set forth herein and comply with Endurra Tech’s warning regarding security measures, if any.
    • 6.3.3  To cooperate with Endurra Tech and competent authorities (if any) to resolve conflict, complaint, fraud or scams relating to account, Services and/or News Coverage Platform.
    • 6.3.4  Please notify us immediately or as soon as practicable if you know or suspect that any third party knows your password, has accessed your account, any unauthorised use of your account or any other breach of security, your account procures any reaction, comments, shares of Services that is not your action; or loss, theft, or unauthorized disclosure of your password or payment information.
    • 6.3.5  You are solely responsible to prepare, apply all reasonable measures to secure, ensure the compatibility between any machine, connection device, system software, application system as used by you to connect, access, approach News Coverage Platform to control, prevent and/or stop any unauthorized, unlawful use, access of your account. It is also your obligations to implement appropriate IT security safeguards (including anti-virus and other security checks) to satisfy your particular requirements as to the safety and reliability of the Services.
    • 6.3.6  You hereby indemnify, defend and hold harmless Endurra Tech and all officers, directors, owners, agents, information providers, affiliates, licensors and licensees (collectively, the "Indemnified Parties") from and against any and all liability and costs, including, without limitation, reasonable attorneys' fees, incurred by the Indemnified Parties in connection with any claim arising out of: a) any breach by you or any user of your account of these Terms or the foregoing representations, warranties and obligations; or b) your gross negligence or willful misconduct. You must cooperate as fully as reasonably required in the defense of any such claim. Endurra Tech reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

Article 7. Prohibited Use

Where using News Coverage Platform, you are not allowed to and/or prohibited: 

  • 7.1 To violate these Terms, other policies, provisions and guidances that Endurra Tech has notified, sent and/or you have confirmed, agreed and accepted with Endurra Tech from time to time, irrespective of your acceptance, agreement or confirmation manner.
  • 7.2 To use Services and/or News Coverage Platform and/or Services to against any jurisdiction’s legal national frontier, sovereignty and/or liberty; damage any jurisdiction’s national security, social order, safety; propagandize invasion war, terrorism, religion, ethnic conflicts; distribute and/or encourage violent, obsence, evil, criminal, dissolute, superstitious activities or behaviours; comment, discuss or debate political topics, issues.
  • 7.3 To use Services and/or News Coverage Platform: a) for any purpose that violates any jurisdiction’s laws, regulations and/or negatively impacts and/or damages images, reputations, prestiges, brand names, and/or any systems of Endurra Tech, other Users or any third party; b) to hinders, interferes in using News Coverage Platform by any other party; c) could disable, damage, or otherwise alter or change the functioning, transmission, or appearance of the Services or Content, including content created by third parties such as advertisers, sponsors, or other users; d) to unlawfully access to any other account, computer system or network as connected to any server or system by unauthoized exploitation of passcode or any other illegal tools; e) to access to system, data or information that is not designed for User’s using; f) to intentionally collect any information, data or materials that is not provided by Endurra Tech.
  • 7.4 To make unauthorised copies, modify, adapt, translate, reverse engineer, disassemble, decompile or create any derivative works of the Services or any Content included therein, including any files, tables or documentation (or any portion thereof) or determine or attempt to determine any source code, algorithms, methods or techniques embodied by the Services or any derivative works thereof;
  • 7.5 To use the Services and/or News Coverage Platform to upload, transmit, distribute, store or otherwise make available in any way: files that contain viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful; any unsolicited or unauthorised advertising, solicitations, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other prohibited form of solicitation; any private information of any third party, including addresses, phone numbers, email addresses, number and feature in the personal identity document (e.g., national identity numbers, passport numbers) or payment means numbers; any material which does or may infringe any copyright, trade mark or other intellectual property or privacy rights of any other person; any material which is defamatory of any person, obscene, offensive, pornographic, hateful or inflammatory; any material that would constitute, encourage or provide instructions for a criminal offence, dangerous activities or self-harm; any material that is deliberately designed to provoke or antagonise people, especially trolling and bullying, or is intended to harass, harm, hurt, scare, distress, embarrass or upset people; any material that contains a threat of any kind, including threats of physical violence; any material that is racist or discriminatory, including discrimination on the basis of someone’s race, religion, age, gender, disability or sexuality;
  • 7.6 To use any robots, spiders, scripts, service, software or manual or automatic device, tool, or process designed to data mine or scrape the Services, data or information from the Services, or otherwise access or collect any data or information from the Services using automated means.
  • 7.7 To use services, software or any manual or automatic device, tool, or process designed to circumvent any restriction, condition, or technological measure that controls access to the Services in any way, including overriding any security feature or bypassing or circumventing any access controls or use limits of the Services;
  • 7.8 To spread virus, trojan, worms or harmful computer programs, software or anything that negatively impacts on system, information, data of News Coverage Platform, other Users and/or Endurra Tech; attempt to probe, scan or test the vulnerability of any Endurra Tech’s system or network or breach any security or authentication measures.
  • 7.9 To use or attempt to use another’s account, service, or system without proper permission, or create a false identity on the Services, News Coverage Platform due to whatsoever purpose.
  • 7.10 To cache or archive the Content (except for a public search engine’s use of spiders for creating search indices).

Engaging in a prohibited use of the Services may result in civil, criminal, and/or administrative penalties, fines, or sanctions against the user and those assisting the user.

Article 8. Content & Intellectual Property Rights 

  • 8.1 All Content and/or Services found on the News Coverage Platform, including but not limited to the software, design, structure, selection, coordination, expression and arrangement of such Content and Services is owned, controlled or licensed by or to Endurra Tech and is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws (“Endurra Tech’s IP”), except those belongs to authors, writers, e-newspapers, e-magazines that are Endurra Tech’s original sources. You shall abide by and maintain all copyright notices, information, and restrictions contained in any Content accessed through the Services. You also agree not to display or use in any manner Endurra Tech’s IP without the express consent of Endurra Tech.
  • 8.2 Subject to your use of Services and News Coverage Platform, you are granted on a limited basis a worldwide, non-exclusive, non-sublicensable and non-transferable right to use the Endurra Tech’s IP and/or Content, to the extent we hold such rights, solely for the purposes of using the Services. Except for the limited license described herein, you are not conferred any right in the Endurra Tech’s IP, your Content or in the Services, by implication, estoppel or otherwise, under copyright or other intellectual property laws, either now or in the future.
  • 8.3 Any use, reproduction, modification, distribution or storage of the Content other than for the purposes of using the Services is expressly prohibited without the written consent of Endurra Tech. You are prohibited to sell, license, rent, or otherwise use or exploit any of the Content for commercial purposes or in any way that infringes the rights of Endurra Tech and/or others eligible owners.
  • 8.4  You understand and ensure that any User Content through the Services must be: a) legal, not infringe any party’s intellectual property right and/or agreement, contract, b) not contains any form of advertising or promotion for goods and services, or any spam or other form of unsolicited communication. You may also extract all or any portion of User Content created by another user to produce additional User Content, including collaborative User Content with other users, that combine and intersperse User Content generated by more than one user. You may also overlay music, graphics, stickers, and other elements provided by other users onto this User Content and transmit this User Content through the Services. The information and materials in the User Content, including User Content that includes Endurra Tech’s IP, have not been verified or approved by us. The views expressed by other users on the Services do not represent our views or values.
  • 8.5 You acknowledge and agree that Endurra Tech may or may not, at Endurra Tech’s discretion, pre-screen, monitor, review or edit any User Content before its appearance on the Services and/or News Coverage Platform, but that Endurra Tech has no obligation to do so and take no responsibility for such User Content. You must do your own assessment and take full responsibility of any arising risk relating to your use of such User Content and/or its accuracy, sufficiency, helpfulness.
  • 8.6  You further acknowledge and agree that Endurra Tech reserves the right (but does not assume the obligation) in its sole discretion to reject, move, edit or remove any User Content that deems abusive, defamatory, obscene, in violation of copyright or trademark laws, in violation of these Terms or otherwise unacceptable.
  • 8.7 Where using Services and/or News Coverage Platform, you grant Endurra Tech a perpetual, non-exclusive, world-wide, royalty-free, sub-licensable license to the User Content, which includes without limitation the right for Endurra Tech, or any third party it designates, to use, copy, transmit, excerpt, publish, distribute, publicly display, publicly perform, communicate to the public, create derivative works of, host, index, cache, tag, encode, modify and adapt (including without limitation the right to adapt to streaming, downloading, broadcast, mobile, digital, thumbnail, scanning or other technologies) in any form or media now known or developed at any time, any User Content posted by you on or to the Services or News Coverage Platform, including any Content posted on or to the Services through a third party. Among other things, Endurra Tech may license comments to third parties for academic, governmental, financial and corporate use. In these cases, steps are taken to remove personal information from such comments. We also do not have an obligation to store User Content for any period of time, and we may remove or delete any User Content for any reason, at any time and without giving you notice.
  • 8.8 Unless otherwise provided in these Terms and/or permitted under applicable law, all kinds of use, announcement, copy, distribution and/or exploitation of Endurra Tech’s IP without our prior acceptance shall be deemed a material violation. 

Article 9. Use of Personal Information

  • Please review the Privacy Policy for a description of our privacy practices. By registering for an account, making a purchase, or otherwise using our Services (including viewing our content with or without payment), you acknowledge and agree that we may and will collect, use, transfer, disclose, and otherwise process your personal data as described in our Privacy Policy. Without limiting the foregoing and for clarity, you agree that we may transfer your personal data a) outside of your home country to another country where the laws may not provide an equivalent level of protection and b) to third parties in accordance with our Privacy Policy.

Article 10. Third party platform or service

  • 10.1 The Services may include content created by third parties, including advertisers, sponsors (“Linked Content”). We may also link to, reference, or promote websites, applications and/or services from third parties. Notwithstanding the foregoing, we does not control, endorse, sponsor, recommend or otherwise accept responsibility for any of this Linked Content. We do not guarantee the accuracy of or endorse the views or opinions given by such third parties. We are not responsible for, and do not control such third parties’ websites, applications, products, or services. Any dealings you have with any third party—including advertisers or sponsors—are solely between you and that third party.
  • 10.2 Whenever you access or use Services via certain third party social media platforms, Endurra Tech shall ensure to supply Services similarly as it is on News Coverage Platform and shall not disclose your personal data to such third party unless such disclosure is so required to process and supply Services, provided that such third party will also comply with the Privacy Policy.
  • 10.3 Whenever you access or use any third party’s services via our Services and/or News Coverage Platform, Endurra Tech shall facilitate any duly processing by third party but in any case the provision of User’s personal data will be solely for the third party’s supply of service and must comply with such third party’s privacy policy. In any and all cases, Endurra Tech shall take no responsibility for such cases.
  • 10.4 Unless otherwise prohibited by Endurra Tech, you may use your own website or your own social media pages, to link or to distribute the Content, provided that such website, pages is not allowed:
    • 10.4.1  Replicating the Content of the News Coverage Platform;
    • 10.4.2 Using a browser or border environment around the Content;
    • 10.4.3  Implying that Endurra Tech are endorsing it or its products and services;
    • 10.4.4  Misrepresenting any state of facts including its relationship with Endurra Tech; and
    • 10.4.5  Using Endurra Tech’s IP without the express consent of Endurra Tech.

Article 11. Disclaimer & Limitation of liability

To the fullest extent permitted by applicable law:

  • 11.1 The Services are provided to you on an “as is” and “as available” basis and we make no warranty or presentation to you with respect to them. We do not make any promises about the Services or the Content, or of the quality, completeness, or accuracy of the Content available on or linked to from the Services. In other words, we disclaim all responsibility for any loss, injury claim, liability, or damage of any kind resulting or related to your access, use, or the unavailability of the Services (or any part thereof).
  • 11.2 Endurra Tech does not make any promise that your use of the Services will meet your requirements, or any information obtained by you as a result of your use of the Services will be accurate or reliable or will provide specific result. You should not rely on the Content as a substitute for, nor does it replace professional legal, financial, tax or medical advice. You hereby acknowledge that the use of the Services is at your sole risk.
  • 11.3 Endurra Tech does not promise or make any guarantee to you that your use of the Services will be uninterrupted, timely, secure, free from error, or free of viruses or malware, or that any defects in operation or functionality of any software provided to you as part of the Services will be corrected. There may be delays, omissions, interruptions and inaccuracy in the Content on the Services or other materials made available through News Coverage Platform.
  • 11.4 Endurra Tech does not represent or endorse the accuracy or reliability of any advice, opinion, statement, or other information displayed, uploaded, or distributed through the Services by any User, information provider or any other person or entity. We will not be liable to you or any other person as a result of a User’s interactions with other Users. You acknowledge that any reliance upon any such opinion, advice, statement, memorandum, or information will be at your sole risk. Endurra Tech also does not control other Users do or say, and we aren’t responsible for their (or your) actions or conduct (whether online or offline) or Content (including unlawful or objectionable content). We also are not responsible for services and features offered by other people or companies, even if you access them through our Services, News Coverage Platform. 
  • 11.5 We strive to keep our News Coverage Platform up-to-date, correct and complete. Nevertheless, errors cannot be entirely ruled out, thus we cannot guarantee the completeness, correctness and topicality of information, including journalistic and editorial information. The publisher may change or delete texts at its own discretion and without notice and such can impact the Content on News Coverage Platform. The publisher, its clients or partners are not responsible for damage, such as direct damage, indirect damage, accidental damage, specific damage to be determined in advance or consequential damage allegedly caused by visiting this website, and consequently assume no liability for this.
  • 11.6 While Endurra Tech strives to supply you with the most accurate, comprehensive, and timely information from trustworthy sources, we cannot guarantee the Content generated by AI absolute accuracy or appropriateness for your specific demands. The opinions expressed in the Content belong to the original source or the AI model and do not necessarily reflect the views of our organization. We do not assume liability for any losses or damages from such using the Content. Opinions expressed or material appearing on such websites are not necessarily shared or endorsed by Endurra Tech and Endurra Tech will not be regarded as the publisher of such opinions or material. You acknowledge and agree that Endurra Tech will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use or reliance of the content, goods and services made available on or through such third party websites.
  • 11.8 To the fullest extent permitted by applicable law, in no event shall Endurra Tech (or its directors, employees, agents, partners or content providers) be liable for: a) any indirect, incidental, special or consequential damages, including but not limited to costs of procurement of substitute products or services, loss of profits or revenue, or loss of data or use, incurred by you or any third party, whether in an action in contract or tort or otherwise, even if it has been advised of the possibility of such damages or b) for any direct damages exceeding the Fees of 12 (twelve) consecutive months that has paid by relevant user.

Article 12. Term, temporary cease, and service termination

  • 12.1 These Terms and the provision of Services shall remain valid and continue until User has deleted his/her account unless otherwise provided in Clause 12.4.
  • 12.2 We may, at any time and without liability to you, cease, terminate the provision of the Services and/or your access to News Coverage Platform. In such cases, we will endeavour to provide you with not less than 14 (fourteen) days’ written notice. However, in certain cases, we may terminate the account, the Services or News Coverage Platform by providing notice with shorter-time or providing notice with immediate effect.
  • 12.3 You may cease, terminate your account, Services and/or News Coverage Platform at any time by providing Endurra Tech with no less than 30 (thirty) days’ written notice prior to the estimated termination, deletion of account. To avoid any doubt, irrespective of any notice from us, you must be liable for your use of Services until receipt of release confirmation that you have no further obligations, responsibilities.
  • 12.4 Notwithstanding any other provision in these Terms, Endurra Tech reserves the right to restrict, temporarily or permanently suspend or terminate the account, the provision of any Services, or News Coverage Platform, at any time and with immediate effect, without incurring liability of any kind to you if:
    • 12.4.1  you have committed violation of two different obligations or violate an obligation twice even though Endurra Tech has warned thereof;
    • 12.4.2  you have violated a material obligation under these Terms;
    • 12.4.3  you have committed a breach of these Terms, and such breach is not cured within 03 (three) days after written notice of such breach is given by us;
    • 12.4.4  you have, at any time provided any false, fake, fraud information, news on News Coverage Platform;
    • 12.4.5  you are in breach of any applicable laws irrespective of such violation’s relevance to use of Services and/or News Coverage Platform; 
    • 12.4.6  you have used Services and/or News Coverage Platform causing immediate and ongoing harm to Endurra Tech and/or other Users.
  • 12.5 Upon termination of account, Services and/or News Coverage Platform, you must:
    • 12.5.1  settle all outstanding Fees, if any.
    • 12.5.2  destroy or return to Endurra Tech all copies of our confidential information.

Article 13. Miscellaneous

  • 13.1 If you have any questions about these Terms, report any violations of these Terms or claim any IP infringement with respect to material that is contained in Services, please contact us by email at support@newscvg.com.
  • 13.2 These Terms shall be construed and governed by the substantive laws of Singapore notwithstanding its conflict of law principles.
  • 13.3 Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (“SIAC”) in accordance with the Arbitration Rules of the SIAC (“SIAC Rules”) for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Singapore. The Tribunal shall consist of 03 arbitrators. The language of the arbitration shall be English.
  • 13.4 All terms and conditions of these Terms shall remain effects even after you have ceased or terminated using News Coverage Platform. In case of ceasing or termination of use of News Coverage Platform, you still have been bound upon by these terms and conditions to the extent that relates to your rights and obligations during the use of Services.

Article 14. Additional terms – App Stores

  • 14.1 You acknowledge and agree that:
    • 14.1.1 These Terms is binding upon you and Endurra Tech, and Apple is not a party to these Terms.
    • 14.1.2 As between Endurra Tech and Apple, it is Endurra Tech that is responsible for News Coverage Platform and the content thereof. You must use the iOS app only on an Apple-branded product that runs iOS. Your use of the app must comply with the terms of use applicable to the Apple source from which you obtain it (including the Usage Rules set forth in the Apple App Store Terms of Service https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). You acknowledge that Apple has no obligation to furnish you with any maintenance and support services with respect to the app.
    • 14.1.3 You acknowledge that Apple is not responsible for addressing any claims you have or any claims of any third party relating to the app or your possession and use of the app, including, but not limited to:
      • a) Services warranty or liability claims;
      • b) Any claim that the app fails to conform to any applicable legal or regulatory requirement;
      • c) claims arising under consumer protection or similar legislation; or
      • d) claims that the app infringes a third party’s intellectual property rights.
    • 14.1.4 In the event of any failure of the iOS version of the app to conform to any applicable warranty that has not been effectively disclaimed by these Terms, you may notify Apple, and Apple will refund the purchase price for the app (if any) to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and, as between Apple and Endurra Tech, any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Endurra Tech’s liability, but only to the extent provided by these Terms. Please read the entire Terms, as other sections of these Terms limit Endurra Tech’s liability in this regard.
  • 14.2 By downloading the News Coverage Platform from Google Play (or its successors), you expressly acknowledge and agree that:
    • 14.2.1 To the extent of any conflict between (a) the Google Play Terms of Services and/or any other policies, regulations, rules which Google designates as default end users license terms for Google Play (“Google Play Terms”); and (b) these Terms, the Google Play Terms shall apply with respect to the News Coverage Platform that you has downloaded from Google Play.
    • 14.2.2 Google does not take any responsibility or liability related to compliance or incompliance by Endurra Tech or you (or any other User) under these Terms or Google Play Terms.
